PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE. YOU ACCEPT THESE TERMS OF SERVICE BY USING OUR SERVICES.

 

Welcome to the Reviva website. We are offering innovative tele-psychiatric services (“Services”) via our website www.clinicreviva.com (“Reviva Website”) linked to third-party platforms such as the Telus Health Collaborative Health Record (CHR) (hereinafter referred to as “Platform”) and Zoom videoconferencing, for the following users:

User(s)”: refers to the Patient who books an appointment with a Psychiatrist using the Reviva Website. Patient is 21 years of age or older AND physically located in the provinces of Quebec, Alberta or Ontario (Canada) at the time of the consultation with the psychiatrist. 

Staff User”: Health professional and administrative clinic teams.

 

Reviva Website is operated by PSYCHVISIT INC., referred to as “we” or “us” or “Psychvisit” in this User Agreement.

 
We are also using third-party software such as the Telus Health Collaborative Health Record (CHR) to connect with you and keep your electronic medical record safe and confidential. When necessary and with your consent, our psychiatrist will meet you by videoconference or by phone. We use Zoom videoconferencing powered by Zoom Video Communications, Inc. (hereinafter referred to as “Zoom”). You can refer to their terms of service here: https://zoom.us/privacy-and-legal

 
In order to obtain a confirmation of the date of your consultation with the psychiatrist, you will have to read and understand the following Terms of service, Privacy policy and sign the Consent form that will be sent to you prior to your first Consultation visit.


We may change the content of the Reviva Website or Platform, including all text, data, information, recordings, graphics, images, icons and any other content (collectively, the Content) at any time without notice. Please review the Terms of Service regularly, as your continued use of our Services and Website will constitute your agreement to any changes.

 

I. TERMS OF SERVICES

By signing-up or using our Services, you are agreeing to be bound by these Terms of Service.


Users must be at least 21 years old and located physically located in the provinces of Alberta, Ontario or Quebec (Canada) at the time of the consultation with the psychiatrist. The User must be referred by a doctor. The User my have a valid Alberta Health Care Insurance Plan (AHCIP) number, or a valid Ontario Health Insurance Plan (OHIP) number, or a Régie d'Assurance Maladie du Québec (RAMQ) number.


Staff User: Administrative User accounts will be created for administrative control over all Users within the Clinic. When signing in to the Reviva Website, you accept these Terms of Service.


Users are responsible for ensuring the accuracy of the information of their accounts and for completing all clinical questionnaires as truthfully as possible.


Users and Staff Users are responsible for their log-in credentials and for keeping their information confidential and accurate.
 

Users and Staff Users are responsible for any activity resulting from the use of their log-in credentials on the Reviva Website. 
 

NB: Your account is personal to you, and you may not share your log-in information with, or allow access to your account by, any third party. 
 

As you will be responsible for all activities that occur under your access credentials, you agree to prevent unauthorized access to or use of the Platform, except in the case of force majeure (eg. theft of your credentials). Please let us know as soon as possible if something happened. If you would share your user credentials, we will reserve the right to close the account without notice for security reasons.

II. DISCLAIMER

BE AWARE: The Reviva Website does not provide any clinical advice and does not recommend or endorse any specific tests, products, procedures, opinions, or other clinical information.

Reviva Website should be used ONLY to connect with Reviva’s psychiatrists for the purpose of using their tele-psychiatric services (“Services”) upon your referral by another doctor.

(a) “As is”

 

The content and materials on the Reviva Website are provided “AS IS” without warranties of any kind either expressed or implied. PSYCHVISIT shall have no responsibility or liability for any content or materials posted on the Reviva Website to the fullest extent possible pursuant to the applicable law. We disclaim all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or other violation of rights.

 

(b) Limitation of liability

 

Under no circumstances, including, but not limited to, negligence, errors, omissions, shall We or our third party licensors (such as Zoom Video Communications Inc. and Telus Health Inc.) be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on the Reviva Website or the Platform, even if We or one of our authorized representatives has been advised of the possibility of such damages.

 

(c) Technical Errors/Bugs

 

Information on the Reviva Website and the Platform may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. We may also make improvements and/or changes in the products and/or services described in this information at any time without notice.

We will not be responsible for the consequences of any problems with the Reviva Website of the Platform that may result from bugs, faulty alerts or faulty notifications.

Any piece of software, including the Reviva Website and the Platform, will always be prone to containing “bugs,” meaning areas where the software malfunctions. We make no claim or guarantee that the Reviva Website or the Platform is free of bugs, and users should be aware that bugs could affect any and all parts of the Reviva Website or the Platform. Therefore, We will not be responsible for the consequences of a bug that a user may experience.

 

(d) Theft or Compromised of any kind of information

 

We will not be responsible for situations where a user’s personal or information may be stolen or compromised by a breach from the Reviva Website or the Platform. Although this Application adheres to industry standards for maintaining the security and privacy of users’ information, We cannot guarantee that there is no risk of users’ information being stolen or compromised. We will not be responsible for stolen or compromised information that results from cyberattacks or users’ negligent behaviour.

 

(e) Suspension or Termination

 

We may suspend your connectivity with the Platform at any time and on immediate notice if we reasonably believe that such suspension is necessary (i) to prevent imminent threats to the privacy, security and integrity of the Health Record Information or to the performance or availability of the Platform; or (ii) to comply with any applicable Canadian laws. We will use commercially reasonable efforts to promptly re-instate connectivity upon elimination of threat or potential non-compliance with applicable Canadian laws.

We will not be liable to you or any third party for any modification, discontinuance, or suspension of the Reviva Website or Application or your Account.

 

(f) Revisions to Terms

 

We reserve the right to update and change the Terms of Service by posting updates and changes to our website. Together with our Privacy Policy, these Terms of Service establish the basis of our relationships with health service providers and patients. Please check occasionally for updates that may impact you.

III. COPYRIGHT

PSYCHVISIT INC. owns all copyrights and intellectual property pertaining to the Reviva Website.

Information other than personal health information collected through the Telus Health Collaborative Health Record (CHR) are owned by PSYCHVISIT INC.

Your personal health information belongs to you. However, the physical or electronic record where your personal health information are stored belongs to the Psychiatrist who is responsible for the creation of your Patient Health record and for controlling access to it by others in accordance with privacy law (more info listed on our Privacy policy).

We do not claim any intellectual property rights over the records you provide through our Services.

All records you are authorized to upload remains yours.

Using our Services does not give you ownership of any intellectual property rights in our Services or to the content that you access.

​IV. APPLICABLE LAW AND TERRITORY OF APPLICATION 

 

These Terms of Service or User Agreement shall be interpreted in accordance with the laws of the Province of Quebec and the laws of Canada that apply in that province. This Agreement shall be considered in all respects as a distance or off-premises contract governed by the laws of the Province of Quebec, without regard to the principles of conflict of laws.

You irrevocably agree, unless requested by law that any dispute arising from these Terms of Service shall be submitted to a court of competent jurisdiction in the judicial district of Montreal, Province of Quebec.

V. FRENCH AND ENGLISH LANGUAGE

If a problem of definition or interpretation arises between the English and French versions of this Agreement, the English version shall prevail.

VI. TERMINATION OF USAGE BY EITHER THE COMPANY OR BY THE USER

(a) Termination by You. You may stop using the Services at any time.

We are concerned about protecting your personal and sensible health information. We put in place a strong Privacy Policy on the nature of the information collected during the use of the Reviva Website and the Platform, the reasons why this information is collected, and the use we make of this information.
